Instructing a barrister to present your case to court.

We have a direct access barrister with extensive legal knowledge in civil enforcement and law relating to seizure of goods, who can advocate for you at court.

If you have had a case prepared by Dealing with Bailiffs, but you prefer to have it professionally and passionately presented at court, then we can provide you with a barrister.

This service is not suitable for claims under £10,000.

But in certain cases where a claim value is under £10,000 you can also recover barristers fees in the small claims track, but you must show that your defendant knew his action is illegal and he has deliberately put you through the trouble of having to go through the courts. The court has a special power is it believes the defendant should have settled your claim.

Cases involving any of the following can be referred.

 

  • Illegal taking or interfering with high-value goods and motor vehicles
  • Distraining items or vehicles used in a persons trade, education or vocation
  • Formal complaints about a bailiff where the bailiff is also represented by a barrister
  • Any enforcement action causing the disruption or damage to the normal operation of a company or business**
  • Non-compliant enforcement of a High Court Writ
  • Non-compliant administration of High Court writs and warrants
  • Third party claims in the High Court
  • Defending a prosecution for cutting off an illegal wheel-clamp
  • Defending a prosecution accused of assaulting a bailiff
  • Claiming damages following a failed or aborted prosecution in 7 & 8 above
  • Claims against police for assisting a bailiff with incorrect documents
  • Use of forged warrants and other documents
  • Damage to goods and vehicles
  • Failure to comply with court orders and injunctions to return seized goods

Cost:

We have negotiated privileged rates for a barrister to advocate you at court. If you win your case, everything is recoverable from your opponent.

At court, £250 per hour + VAT

Consultation £100 per hour + VAT

Travel to anywhere in England & Wales, 45p per mile

Miscellaneous disbursements, photocopying & sundries.
