Reclaiming bailiffs fees and charges more than 6 years

Normally a debt cannot be revived after a period of 6 years has passed, however with bailiff and High Court Enforcement Officers fees that are unlawful, you can still reclaim them no matter how long ago you paid them.

Section 32 of the Limitation Act 1980 has a number of exclusions which prevents a debt from becoming statute barred under Section 2 of the Act.

These exclusions apply if the debt was created:-

 

1. Fraudulently

2. By mistake

3. By concealment

 

Unlawful or unregulated bailiffs fees can be recovered using all of the above grounds in that order.

 

Fraudulent fees is when a bailiff charged fees for work not done.

Mistake, if the bailiff or the police say the fraud is a civil matter.

If you are reclaiming bailiffs fees from a long time ago, and you have only just discovered you have a right to reclaim them, then consider using the small claims court because this allows you to add statutory interest at 8% a year all the way back to the date you paid them.
