If you want to recover damages for the unlawful deprivation of your car, these are called "Special Damages". I can draft these for you, £100. You do not need me to attend court for you for claims in the small claims court - unless you really need me to be there. Your statements I draft for you will explain everything to the judge.
You can apply for these costs as disbursements, but there is no guarantee you will get them. You have a further opportunity to recover them in your Special Damages claim after you have got your car back.
Rental car
Taxis - especially if the car is used to carry a disabled person
Public transport
Recovery service to collect the vehicle from the bailiff compound or auction company
Vehicle inspection and damage report at the vehicle compound, or, by your choice of garage on its return
Anything else you paid or lost as a result of the loss of use of your car (or trade vehicle) - including disruption to your business.
Loss of Road Fund License, including DVLA surrender and renewal charges
Unused motor insurance on the vehicle, including cancellation and amendment fees
Getting it valeted and serviced to return it to road use
Vehicle depreciation and the cost of estimating depreciation amount professionally
Plus, the following daily rates depending on the car. Figures are only a guide, and can be professionally loss-adjusted:
2014 Range Rover - £100+ per day
2012 Nissan Juke - £75 a day
2009 Mini Cooper - £45 a day
Any trade vehicle, such as a van, truck, minibus etc. - the daily rental cost of its replacement, or the loss of business, whichever is more suitable for you. Business is not a statutory requirement. Section 127 of the Road Traffic Act 1988.
2002 Ford Focus - £15 a day
Jalopy - £10 a day
Supercars, Porsches, Lamborghinis etc. - a loss adjuster makes an assessment of the material damages according to circumstances.
