Excessive Levy

Paragraph 66 of the Taking Control of Goods: National Standards 2014 states;

Enforcement agents should take all reasonable steps to satisfy themselves that the value of the goods taken into control to cover the sum outstanding is proportional to the value of the debt and fees owed.

 

Enforcement regulations are silent about excessive levies, therefore case law remains available for defining an excessive levy.

If a bailiff takes control of two or more vehicles for a single PCN or a small debt, then this could amount to excessive levy
