Vehicle storage fees, make an offer to return the car pending outcome of an appeal.
After taking a vehicle, bailiff companies will charge fees for storing your vehicle.
If you are appealing the debt, applying to stop a writ or making a declaration to court to void the debt, then the enforcement is placed on hold when your application is lodged. The hold continues until the court had decided the outcome of your appeal or application.
Bailiff companies have a policy to continue charging storage fees at a daily rate of up to £40 a day.
If your appeal is allowed or the debt is quashed, you are no longer liable for the debt or the enforcement fees. The bailiff company will still charge you storage fees. They will even continue to hold your vehicle as a lien to obtain payment from you.
If your appeal or application is unsuccessful, you are still liable for the original debt and the enforcement fees.
However, you have a trump card. You can take a step to protect yourself from liability for the non-statutory fees - including the storage fees.
You approach the council, or creditor and give them an opportunity to return the car to you pending the outcome of your appeal. If the opportunity is declined or ignored, you will still have to pay the storage fees to get your car back, but you can recover them from the council or creditor because they turned down an opportunity to avoid continuing storage fees being incurred and exposed you to a loss.
